TERMS OF REPAIR & SERVICE AGREEMENT

 

1. Acceptance of Terms & Authorization for Service

 

By initiating a service order and remitting your device to Gnome Nation Games, you expressly consent to these Terms of Repair. This consent is absolute, and cancellations are not accepted once the item is in transit. You grant Gnome Nation Games full authorization to disassemble, test, modify, remove parts, install components, and experiment upon the device to effectuate the requested repair.

 

2. Inherent Risks & Limitation of Liability

 

Electronic repair inherently involves unpredictability. You acknowledge that diagnostic and repair attempts carry a risk that the device may not be repairable, may sustain unintentional damage during the process, or may be rendered entirely useless. Gnome Nation Games assumes no liability for devices that degrade in condition or end up in worse shape during a good-faith repair attempt.

 

3. Payment Terms, Shipping Fees, & Abandonment of Property

 

Payment in full is required immediately upon the issuance of an invoice via our payment processor. Free return shipping is strictly built into the repair price for successful services within the continental United States. If a repair is unsuccessful or service is refused, free return shipping is voided, and you are strictly liable for diagnostic fees and return shipping costs. Shipping to outside territories, including Alaska and Hawaii, incurs supplementary fees. If any invoice—whether for a completed repair or return shipping on an unfixed device—remains unpaid for thirty (30) consecutive days, the device is legally deemed abandoned. Gnome Nation Games retains the explicit right to salvage, sell, or liquidate abandoned devices to recover labor and component costs.

 

4. Strict Address Policy & Shipping Liability

 

Gnome Nation Games ships exclusively to the exact, automatically generated address provided at the checkout or invoice payment stage (including Apple Pay and Google Wallet). We do not reference or honor addresses submitted elsewhere on the website, written inside the physical package, or communicated via messages and emails. We cannot override the shipping address after shipment. You are solely responsible for verifying the accuracy of your address before payment. Gnome Nation Games holds zero liability for packages delivered to old residences, inaccessible work locations, or any incomplete address provided by the customer. If a package is returned due to an address error, original postage is non-refundable, and you must pay new postage for re-shipment without exception.

 

5. Biological Contamination & Hazardous Conditions

 

Devices presenting biological hazards—including live or deceased insects and animal urine—will immediately incur an automatic $75 hazard fee added to the service cost. Devices exhibiting cockroach infestation are categorically excluded from any warranty coverage due to the likelihood of reoccurrence.

 

Gnome Nation Games reserves the unilateral right to immediately terminate service, reseal the contaminated unit, and return it to the customer without completion.

 

6. Liquid Damage & Prior Modification Disclaimers

 

Liquid exposure irrevocably voids any available warranty, regardless of whether the exposure occurred before or after our service. We strictly repair components damaged by liquid; we do not "repair liquid damage" itself, as affected units are permanently compromised and may develop secondary faults. We reserve the right to refuse service on liquid-damaged units, and cleanup is subject to supplementary fees. Devices subjected to prior third-party repair attempts often require extended bench time and additional components, which will incur elevated service fees. If prior botched repairs render the device entirely unfixable, a fee for the time and parts utilized in our attempt will still be assessed. We explicitly refuse service on devices with software modifications, hacked firmware (such as modded Nintendo Switch systems), or altered mechanical inputs; cosmetic shell modifications are the sole exception.

 

7. Data Loss & System Resets

 

While we prioritize data retention, Gnome Nation Games is focused strictly on hardware repair and is not liable for data loss. We reserve the right to perform system resets if deemed necessary to restore hardware functionality, such as resetting an Xbox locked in low-resolution mode following an HDMI port replacement.

 

8. Finality of Sale & Limited Warranty

 

All service sales are final, and absolutely no refunds will be issued under any circumstances. Claims of subsequent failure do not constitute grounds for a refund, and we must be granted the opportunity to inspect the device. Gnome Nation Games provides a strictly limited sixty (60) day warranty commencing on the return delivery date. This warranty exclusively covers defects in the specific service provided and the exact issue addressed during drop-off. (For example, an optical drive is not warrantied if the service was for a hard drive replacement). The warranty is voided by customer-induced damage, failure to utilize approved charging hardware, or failure to use brand-new HDMI cords for display repairs. If a warranted defect occurs within the 60-day window, we will reperform the specific repair at no additional charge. The customer remains responsible for inbound shipping costs, while Gnome Nation Games covers the return transit.

 

9. Transit Insurance

 

Shipping insurance is strictly optional. If selected, it is billed at 5% of the invoice sub-total and exclusively insures the value of the repair invoice, not the hardware's replacement value. Customers with lost packages must utilize the mail carrier's search process; claims for damaged items require verifiable photographic proof. We package items securely to ensure safe transit.

 

10. Governing Terms

 

This agreement is governed by the specific terms in effect at the moment the service order is placed or the hardware is physically received.

 

11. Choice of Law

 

This agreement, and any dispute arising out of or related to these Terms of Repair, shall be governed by, construed, and enforced in accordance with the laws of the State of Connecticut, without regard to its conflict of law principles.

 

12. Forum Selection & Jurisdiction

 

Any legal suit, action, or proceeding arising out of or related to this agreement that is not subject to mandatory arbitration shall be instituted exclusively in the federal or state courts located in Litchfield County, Connecticut. By initiating a service order, you unequivocally consent to the personal jurisdiction of these courts and waive any objections to this venue, including any claims of an inconvenient forum.

 

13. Mandatory Arbitration & Class Action Waiver

 

Any controversy, claim, or dispute arising out of or relating to this contract, or the breach thereof, shall be settled exclusively by mandatory, binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration proceedings shall take place in Torrington, Connecticut. You expressly waive any right to bring, participate in, or serve as a class representative in any class action, consolidated, or representative proceeding against Gnome Nation Games. The arbitrator’s decision shall be final and legally binding, and judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
